Privacy Policy

Miracle Mama Inc. ("Miracle Mama," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through miraclemama.com and our related pages, emails, text messages, social accounts, and events (together, the "Services"), how we use and share it, and the choices and rights you have.

By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.


1. A note about the information you share with us

Many of our customers are pregnant, nursing, or navigating a hormonal transition, and you may tell us about that — in a product review, a customer service email, a quiz answer, or a note at checkout. We are not a healthcare provider, and information you share with us is not protected health information under HIPAA. We treat this information carefully: we do not sell it, and we use it only to serve you, improve our products, and communicate with you as described below. Please share only what you're comfortable sharing.


2. Information we collect

Information you give us

  • Contact and account information — name, email address, phone number, shipping and billing addresses, password, and account preferences.
  • Order information — the products you buy, subscription selections, gift messages, order history, returns, and delivery details.
  • Payment information — payment card and billing details are collected and processed by our payment processors (including Shopify Payments, Shop Pay, PayPal, and similar providers). We do not store full payment card numbers on our systems; we receive a truncated card number, card type, and authorization result.
  • Marketing preferences — email and SMS signups, the interests you select, and giveaway or event entries.
  • Content you submit — product reviews, photos, survey and quiz responses, customer service messages, podcast and community sign-ups, affiliate or creator applications, and wholesale inquiries.

Information collected automatically

  • Device and usage information — IP address, device and browser type, operating system, language, referring and exit pages, pages viewed, search terms, items added to cart, and time spent on the Services.
  • Cookies and similar technologies — cookies, pixels, tags, SDKs, and local storage placed by us and by our service providers and advertising partners. See Section 5.
  • Location information — approximate location derived from your IP address. We do not collect precise geolocation from your device.

Information from other sources

  • Retail and marketplace partners — order and customer information from Amazon, Faire, and retail or wholesale partners where you buy our products.
  • Service providers — email and SMS platforms, subscription and loyalty tools, review platforms, shipping carriers, and fraud-prevention services.
  • Advertising and analytics partners — information about how you interact with our ads and content on other sites and apps.
  • Social platforms — information you make available to us when you follow, tag, message, or interact with our accounts, consistent with that platform's settings and policies.

We do not knowingly collect government ID numbers, financial account numbers, biometric data, or precise geolocation.


3. How we use your information

We use personal information to:

  • process, fulfill, and deliver your orders, subscriptions, and returns;
  • manage your account, subscription, and any loyalty, referral, or rewards program;
  • provide customer service and respond to your questions;
  • send transactional messages (order confirmations, shipping updates, subscription reminders, service notices);
  • send marketing emails and, with your consent, marketing text messages;
  • personalize the Services, including product recommendations and the content you see;
  • measure and improve our products, website, and marketing, including through analytics;
  • advertise our products to you on other websites, apps, and social platforms;
  • run giveaways, events, surveys, our podcast, and our creator and affiliate programs;
  • detect, investigate, and prevent fraud, abuse, and security incidents; and
  • comply with legal obligations and enforce our terms.

4. How we share your information

We share personal information with:

  • Service providers and processors who perform services for us, including e-commerce and hosting (Shopify), payment processing, email and SMS marketing (Klaviyo), subscription management (Recharge), reviews, customer support, order fulfillment and shipping carriers, analytics, and fraud prevention. They may use the information only to perform services for us.
  • Advertising and analytics partners, including Google, Meta, TikTok, Pinterest, and similar platforms, which may collect information about your activity on the Services through cookies and pixels to deliver and measure advertising. Under some state privacy laws, this activity is considered a "sale" or "sharing" of personal information, or "targeted advertising." See Section 6 for how to opt out.
  • Retail, wholesale, and marketplace partners where relevant to your order.
  • Professional advisors such as lawyers, accountants, and auditors.
  • Corporate transactions — in connection with a merger, financing, acquisition, reorganization, or sale of assets, personal information may be transferred as a business asset.
  • Legal and safety — when we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect the rights, property, or safety of Miracle Mama, our customers, or others.

We do not sell your personal information for money. We do not share the contents of your customer service messages, reviews, or survey responses with advertising partners for their own marketing purposes.


5. Cookies and tracking technologies

We and our partners use cookies and similar technologies to keep your cart and session working, remember your preferences, understand how the Services are used, and deliver and measure advertising.

You can control cookies through your browser settings, and you can opt out of many advertising cookies through the tools at optout.aboutads.info and optout.networkadvertising.org. Blocking some cookies may affect how the Services work.

Opt-out preference signals. We honor the Global Privacy Control (GPC) and other recognized opt-out preference signals as a request to opt out of the sale or sharing of personal information and of targeted advertising for the browser or device sending the signal.


6. Your privacy choices

Email

Every marketing email includes an unsubscribe link. You may also email info@miraclemama.com. We will still send transactional messages about orders and subscriptions.

Text messages

If you consent to marketing texts, message and data rates may apply and message frequency varies. Reply STOP to any message to opt out, or HELP for help. We do not sell or rent mobile phone numbers or SMS consent to third parties, and we do not share them with third parties for their own marketing purposes.

Targeted advertising, sale, and sharing

To opt out of targeted advertising and of the "sale" or "sharing" of your personal information, you can use the "Your Privacy Choices" link in our website footer, send a Global Privacy Control signal from your browser, or email info@miraclemama.com with "Opt Out" in the subject line.

Account and subscription

You can view and update your account information, addresses, and subscription settings by logging into your account, or by emailing info@miraclemama.com.


7. Your privacy rights

Depending on where you live, you may have some or all of the following rights under state privacy laws, including the California Consumer Privacy Act as amended (CCPA/CPRA), the Texas Data Privacy and Security Act, and comparable laws in Colorado, Connecticut, Virginia, Oregon, Montana, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Nebraska, New Hampshire, New Jersey, Rhode Island, Tennessee, and Utah:

  • Know / access — confirm whether we process your personal information and obtain a copy of it.
  • Delete — request deletion of the personal information we hold about you.
  • Correct — request correction of inaccurate personal information.
  • Portability — obtain a copy of your personal information in a portable format.
  • Opt out — opt out of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects.
  • Limit sensitive data — limit the use and disclosure of sensitive personal information. We do not use or disclose sensitive personal information for purposes other than those permitted by law.
  • Non-discrimination — exercise these rights without receiving different pricing or service, except as permitted by law in connection with a financial incentive program.

How to submit a request

Email info@miraclemama.com with the subject line "Privacy Request," or write to us at the address in Section 13. Please tell us what right you wish to exercise and include enough information for us to verify your identity — typically the email address and order details associated with your purchases. We will not use this information for any purpose other than verifying your request.

An authorized agent may submit a request on your behalf with written permission signed by you; we may ask you to verify your identity directly.

We will respond within the time period required by applicable law (generally 45 days, extendable by an additional 45 days where permitted, with notice to you).

Appeals

If we decline your request, you may appeal by replying to our response or by emailing info@miraclemama.com with "Privacy Appeal" in the subject line. We will respond in writing within 60 days with our decision and an explanation. If your appeal is denied, you may contact your state attorney general to submit a complaint. Texas residents may contact the Office of the Texas Attorney General at texasattorneygeneral.gov.

California notice of financial incentive

Our subscription discounts, referral offers, and email and SMS signup offers may be considered "financial incentive" programs because we collect personal information in exchange for a price or service difference. The value of your personal information to us is reasonably related to the value of the discount offered, calculated by reference to the expected revenue from participating customers relative to the cost of the discount. Participation is voluntary; you may withdraw at any time by unsubscribing or by contacting us at info@miraclemama.com.

Categories collected, disclosed, and sold or shared (CCPA)

In the past 12 months we have collected the categories of personal information described in Section 2 — identifiers, customer records, commercial information, internet and network activity, approximate geolocation, and inferences drawn from that information — and have disclosed each of those categories to the service providers and partners described in Section 4 for the business purposes described in Section 3. We have "shared" identifiers, internet and network activity, and inferences with advertising partners for cross-context behavioral advertising. We have not sold personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age.


8. Data retention

We keep personal information for as long as needed for the purposes described in this policy: account and order records for as long as your account is active and afterward as required for tax, accounting, warranty, and legal purposes (generally seven years for transaction records); marketing contact information until you unsubscribe and for a reasonable period afterward to honor your opt-out; and website and analytics data for a shorter period consistent with our analytics settings. We then delete or de-identify it.


9. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vetting of our service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us at info@miraclemama.com.


10. Children's privacy

The Services are intended for adults. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us personal information, contact us at info@miraclemama.com and we will delete it.


11. Third-party links and platforms

The Services contain links to third-party sites and platforms, including social media, retail partners, and podcast hosts. We are not responsible for their privacy practices. Please review their policies before providing information to them.


12. Where we operate

We operate in the United States, and our Services are directed to customers in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country.


13. Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page and update the "Last updated" date. If we make material changes, we will provide additional notice, such as by email or a notice on our website. Your continued use of the Services after the changes take effect means you accept the updated policy.
